Trademarks

A TrademarkTM is a word, phrase, symbol or design, or a combination of words, phrases, symbols, or designs legally registered or established by use as representing a company or a product.  A trademark is eligible for protection if it is in use in commerce and is distinctive.

A trade name is the formal name of a business. Trade names are registered with county clerks and with the Texas Department of State if the business is incorporated. 

If a trademark has not been claimed, you can register it online at the US Patent and Trademark Office

How to Search for a Trademark:
There are three types of trademarks: those that are federally registered, those that are state registered, and those that are unregistered, also called common-law trade names and trademarks.
